Welcome to Labourscart ("Company", "We", "Us", "Our").

These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and all related services ("Platform", "Services").

By using Labourscart, you agree to these Terms. If you do not agree, please do not use our Platform.

1. Eligibility

To use Labourscart, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a contract
  • Provide accurate registration details
  • Use the platform in compliance with all applicable laws

Labourers must complete KYC verification to accept job assignments.

2. Definitions

  • "Employer" / "Client" – An individual or business hiring labour.
  • "Labourer" / "Worker" – A person offering labour services through the platform.
  • "Booking" – A confirmed request for labour service.
  • "Service Fee" – Charges applicable for using Labourscart Services.

3. Scope of Services

Labourscart provides a digital platform that enables:

  • Employers to hire skilled, semi-skilled, and unskilled labour
  • Labourers to receive job opportunities
  • Secure payment processing
  • Real-time job updates and communication
  • Workforce management tools for enterprises

Labourscart is not an employer of labourers.

Workers are independent service providers.

4. User Responsibilities

4.1 Employer Responsibilities

Employers must:

  • Provide accurate job details
  • Ensure a safe working environment
  • Pay the required charges promptly
  • Treat workers ethically and respectfully
  • Comply with labour regulations applicable in their region

4.2 Labourer Responsibilities

Labourers must:

  • Provide accurate skill information
  • Arrive on time for jobs
  • Perform services professionally
  • Follow safety rules at job sites
  • Respect employers and workplace guidelines

5. Account Registration

Users must create an account to access most features.

You agree to:

  • Provide accurate information
  • Keep login credentials confidential
  • Be responsible for all activities under your account

Labourscart may suspend or terminate accounts for misconduct or policy violations.

6. Booking & Job Assignments

  • Job assignments are based on skill match, availability, and verification status.
  • Employers must review job details before confirming.
  • Labourers may accept or decline job offers.
  • Labourscart is not responsible for job performance disputes but may mediate when possible.

7. Payments & Pricing

  • Employers agree to pay the service fee, labour charges, and applicable taxes.
  • Payments are processed through secure third-party payment gateways.
  • Labourers receive payouts to their registered bank account/wallet.
  • Labourscart does not store payment card details.

Refunds & Cancellations

Handled according to Labourscart's Refund Policy.

8. KYC, Verification, and Background Checks

Labourscart may:

  • Collect identity documents
  • Verify labourer authenticity
  • Conduct background checks when required

False information may lead to account termination.

9. Prohibited Activities

Users are prohibited from:

  • Misusing the platform
  • Creating fake accounts
  • Providing false information
  • Attempting to exploit workers or employers
  • Using the service for illegal or harmful activities
  • Bypassing platform fees or job workflows
  • Engaging in abusive, unsafe, or discriminatory behavior

Violation may result in legal action and permanent ban.

10. Content Ownership

All content on the platform—including text, designs, logos, software, and data—is the property of Labourscart and protected by Indian and international intellectual property laws.

Users may not copy, reproduce, or distribute platform content without permission.

11. Third-Party Services

Labourscart may link to or integrate with third-party:

  • Payment gateways
  • Background verification agencies
  • Analytics providers

We are not responsible for the policies or actions of third-party services.

12. Limitation of Liability

Labourscart is not liable for:

  • Accidents, injuries, damages, or losses during jobs
  • Misconduct by labourers or employers
  • Errors caused by incorrect user information
  • Payment delays due to third-party gateways
  • Downtime or interruptions of the platform

Use of the platform is at your own risk.

13. Indemnification

Users agree to indemnify and hold Labourscart harmless from any:

  • Claims
  • Damages
  • Losses
  • Legal fees

arising from misuse of the platform or violation of these Terms.

14. Termination

Labourscart may suspend or terminate your access at any time if:

  • You violate these Terms
  • Provide false or misleading information
  • Engage in unsafe or fraudulent activity

You may also delete your account at any time.

15. Changes to Terms

We may update these Terms from time to time.

Updates will be posted with a revised "Last Updated" date.

Continued use of the platform means you accept the updated Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Any disputes shall be resolved in the courts of Uttar Pradesh, unless otherwise required by regional laws.
